GENERAL CONDITIONS OF SALE

These general terms and conditions of sale apply to the sale and purchase of products through the BLANCSHOP.IT website concluded between BLANC DI SALUTATI RAFFAELLA, headquartered in VIA DELL’ANFITEATRO,2, Tax Code SLTRFL72L60H501Y, VAT No. and registration number with the Companies’ Register of Rome No. 17605531007 (hereinafter, “BLANC DI SALUTATI RAFFAELLA“) and any person who makes online purchases on the website BLANCSHOP.IT, hereinafter referred to as “Customer”.

These general conditions govern all purchases made through the website BLANCSHOP.IT, in accordance with the provisions of Legislative Decree No. 206 of September 6, 2005, as amended (hereinafter, the “Consumer Code“). When placing an order through the web page, confirming that he/she has read and accepted the General Conditions of Sale, the Customer declares his/her unconditional acceptance of the conditions and terms specified below.

ARTICLE 1 – Subject of the contract

With these general conditions of sale, BLANC DI SALUTATI RAFFAELLA sells and the CUSTOMER purchases at a distance the tangible movable goods indicated and offered for sale on the site BLANCSHOP.IT, pursuant to Art. 45 et seq. Of Legislative Decree 206/2005 and by Legislative Decree 70/2003. The contract is concluded exclusively through the Internet, through the access of the CUSTOMER to the address BLANCSHOP.IT and the realization of a purchase order according to the procedure provided by the site itself.
The customer agrees to read, before proceeding to the confirmation of his order, these general conditions of sale, in particular the pre-contractual information provided by BLANC DI SALUTATI RAFFAELLA.

ARTICLE 3 – Conclusion and effectiveness of the contract.

The contract of sale with the sending by BLANC DI SALUTATI RAFFAELLA to the CUSTOMER of an e-mail confirming the order. The e-mail contains the data of the CUSTOMER and the order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent and the link to be able to print and store the copy of these conditions.
The CUSTOMER agrees to verify the correctness of the personal data contained therein and promptly notify BLANC DI SALUTATI RAFFAELLA of any corrections.

The CUSTOMER has the option to cancel the order placed no later than one hour after receiving the confirmation email.

BLANC DI SALUTATI RAFFAELLA In addition, photographs of products presented on BLANCSHOP.IT do not constitute a contractual element, as they are only representative.

ARTICLE 4 – Availability of products

Product availability refers to actual availability at the time the CUSTOMER places the order. However, this availability should be considered purely indicative because, as a result of the simultaneous presence on the site of several users, the products could be sold to other CUSTOMERS before the confirmation of the order.

When BLANC DI SALUTATI RAFFAELLA receives the order from the CUSTOMER, it will send an e-mail confirmation and summary of the order.
Even after sending the order confirmation e-mail sent by BLANC DI SALUTATI RAFFAELLA, there may be cases of partial or total unavailability of goods.

If an order exceeds the existing quantity in stock or in case of unexpected unavailability of the product, the BLANC DI SALUTATI RAFFAELLA, by e-mail, will let the CUSTOMER know if the product is no longer bookable or what is the waiting time to obtain the chosen product, asking whether it intends to confirm the order or not.
If the CUSTOMER requests the cancellation of the order, terminating the contract, BLANC DI SALUTATI RAFFAELLA will refund the amount paid within 15 days from the day BLANC DI SALUTATI RAFFAELLA became aware of the customer’s decision to terminate the contract.

If the CUSTOMER requests the cancellation of the order, under the terms of Article 3, BLANC DI SALUTATI RAFFAELLA will refund the amount paid within 15 days of becoming aware of the CUSTOMER’s decision to terminate the contract.

The CUSTOMER shall notify BLANC DI SALUTATI RAFFAELLA of any inability to accept the orders received within 24 (twenty-four) hours starting from the business day following that on which THE CUSTOMER transmitted the order and shall refund any sums already paid for the payment of the supply.

THE CUSTOMER undertakes to verify the accuracy of the data in the order confirmation e-mail and to notify BLANC DI SALUTATI RAFFAELLA of any corrections within 24 (twenty-four) hours of receipt thereof. In the absence of such communication from the CUSTOMER within the specified period, the Seller reserves the right to cancel the order. Any additional charges resulting from errors not reported in a timely manner shall be borne by the CUSTOMER.

ARTICLE 5 – Method of payment

Any payment by the CUSTOMER may be made only by credit cards via PayPal at BLANCSHOP.IT or by bank transfer.

In the event that the chosen method of payment is bank transfer, it should be noted that only payments sent no later than 48 hours after the order will be accepted, and that beyond this deadline the order is considered canceled.

For transaction security reasons, COMPANY NAME reserves the right to request the submission of the details or copy of an identity document of the Credit Card holder.

The BLANC DI SALUTATI RAFFAELLA will issue the receipt for the purchase of the product(s), sending it by e-mail to the holder of the order within — (———-) hours from the e-mail confirmation and summary of the order or making it available on the Buyer’s personal page. The information provided by the Buyer will be the basis for issuing the receipt.

ARTICLE 6 – Prices

All sales prices of the products shown on the site BLANCSHOP.IT are expressed in Euro, represent an offer to the public pursuant to art. 1336 c.c. and include VAT.
Shipping costs are not included in the purchase price, but are indicated and calculated at the conclusion of the purchase process before making payment and vary depending on the order placed.
The CUSTOMER accepts the right of BLANC DI SALUTATI RAFFAELLA to change its prices at any time, however, the goods will be invoiced based on the prices indicated on the site at the time of order creation and indicated in the confirmation e-mail sent by BLANC DI SALUTATI RAFFAELLA to the CUSTOMER. Shipments outside the European Union,  provide for the payment of import taxes, which are the sole responsibility and liability of the customer.
In the event of a computer error, manual, technical, or any other nature that may result in a substantial change, not foreseen by BLANC DI SALUTATI RAFFAELLA, of the sale price to the public, which makes it exorbitant or clearly derisory, the purchase order will be considered invalid and canceled and the amount paid by the CUSTOMER will be refunded within 30 days from the day of cancellation.

 

ARTICLE 7 – Right of withdrawal

In accordance with the legal provisions in force, the CUSTOMER who holds the quality of Consumer has the right to withdraw from the purchase without penalty and without specifying the reason, within the period of 14 days under Article 57 of Legislative Decree 206/2005 starting from the date of receipt of the products.
The CUSTOMER who intends to exercise the right of withdrawal must communicate it within the above period, to BLANC DI SALUTATI RAFFAELLA by means of an explicit statement, which may be sent by registered letter with acknowledgment of receipt to the address

To this end, the Buyer may: a) use the standard withdrawal form made available to him on the site (“Standard Withdrawal Form”); or b) submit any other explicit statement of his decision to withdraw from the contract.
In case of exercising the right of withdrawal, the CUSTOMER is required to return the goods within 14 days from the day on which he communicated to BLANC DI SALUTATI RAFFAELLA his wish to withdraw from the contract by email to the address:

Direct costs of returning products are the responsibility of the CUSTOMER.
Goods must be returned undamaged, unused, properly packaged, and complete with attached tax documentation. Under no circumstances will merchandise that has not been returned in perfect condition be replaced or refunded at:

Without prejudice to the right to verify compliance with the above, BLANC DI SALUTATI RAFFAELLA will refund the amount of the products subject to withdrawal within a maximum period of 14 days.
As provided for in Article 56 paragraph 3 of Legislative Decree 206/2005, as amended by D.lgs 21/2014, BLANC DI SALUTATI RAFFAELLA may suspend the refund until receipt of the goods or at the discretion of the same until the CUSTOMER has demonstrated that he has sent the goods back to BLANC DI SALUTATI RAFFAELLA.
BLANC DI SALUTATI RAFFAELLA will make the refund using the same means of payment chosen by the CUSTOMER at the time of purchase. In the case of payment made by bank transfer, and if the CUSTOMER intends to exercise his right of withdrawal, he must provide BLANC DI SALUTATI RAFFAELLA, by accessing the contact section or by sending an email to INFO@BLANCSHOP.IT, the bank details: IBAN, SWIFT and BIC necessary to make the refund.

ARTICLE 7.bis – Exceptions to the right of withdrawal

In accordance with Article 59(h) of the Consumer Code, the CUSTOMER may not exercise the right of withdrawal for all products that have been custom-made or clearly customized to the specifications requested by the CUSTOMER.

In particular, the right of withdrawal is excluded for products that, although starting from standard models available on the BLANC DI SALUTATI RAFFAELLA website, have been modified or customized at the CUSTOMER’S request, so as to meet the specifically commissioned needs.

The CUSTOMER, therefore, agrees and acknowledges that once the customization is confirmed and the production process begins, it will not be possible to cancel the order or request a refund unless the product is defective or does not conform to the description provided at the time of purchase.

 

 

ARTICLE 8 – Methods of delivery

BLANC DI SALUTATI RAFFAELLA will accept orders for delivery worldwide. The products will be delivered by express courier to the address indicated by the CUSTOMER when placing the order no later than 30 days from the date of receipt by the CUSTOMER of the order confirmation e-mail sent by BLANC DI SALUTATI RAFFAELLA.

ARTICLE 9 – Responsibility

BLANC DI SALUTATI RAFFAELLA assumes no responsibility for inefficiencies attributable to force majeure or unforeseeable circumstances, even where dependent on malfunctions and failures of the Internet, in the event that it fails to execute the order within the time stipulated in the contract.

ARTICLE 10 – Access to the site

The CUSTOMER has the right to access the site for browsing and making purchases. No other use, particularly commercial, of the site or its content is permitted. The integrity of the elements of this site, whether sound or visual, and the related technology used remain the property of BLANC DI SALUTATI RAFFAELLA and are protected by intellectual property law.

ARTICLE 11 – Privacy Policy 

BLANC DI SALUTATI RAFFAELLA is aware of the importance of its users’ personal data and therefore intends to inform you and provide you with as much control as possible over the management of personal information collected through our Site.

ARTICLE 13 – Integrity

These General Terms and Conditions of Sale shall consist of the entirety of their component clauses. If one or more of the provisions of these General Terms and Conditions of Sale is deemed invalid or declared invalid pursuant to law, regulation, or following a decision by a court having jurisdiction, the other provisions shall continue in full force and effect.

ARTICLE 14 – Applicable Law and Jurisdiction.

These Terms and Conditions are subject to Italian law.

All disputes arising from this contract will be devolved to an attempt at conciliation at the Mediation Body identified for this purpose.
Any dispute that does not find a solution through the aforementioned body will be submitted to the exclusive jurisdiction of the Court of the place of residence or domicile of the CUSTOMER, if located in the territory of the State.
In any case, it is always possible to optionally resort to the mediation procedures referred to in Legislative Decree 28/2010, for the resolution of any disputes arising in the interpretation and execution of these conditions of sale.
